SHERIFFS SALE BY VIRTUE OF A WRIT OF EXECUTION, ISSUED OUT OF THE COURT OF COMMON PLEAS OF MONTOUR COUNTY, TO ME DIRECTED WILL BE EXPOSED TO PUBLIC SALE ON WEDNESDAY THE 30th DAY OF JULY A.D., 2025 AT 11:00 OCLOCK A.M. AT THE COURTHOUSE OF MONTOUR COUNTY, 253 MILL STREET, DANVILLE, MONTOUR COUNTY, PA. THE FOLLOWING PROPERTY, VIZ: All that certain messuage or tenement and town lot of land situate on the Eastern side of Upper Mulberry Street in the Fourth Ward of the Borough of Danville, County of Montour and State of Pennsylvania, bounded and described as follow, to-wit: Front on Upper Mulberry Street on the Western 173 feet, adjoining an alley on the Northward 143 feet, an alley on the Eastward 173 feet, and lot now or formerly owned by Aaron Williams on the Southward 143 feet, whereon are erected a two-story frame dwelling house and other improvements. BEING KNOWN AS: 1294 UPPER MULBERRY STREET, DANVILLE, PA 17821 PROPERTY ID NUMBER: 14-81-216 BEING THE SAME PREMISES WHICH MICHAEL J. COPENHAVER AND TRACY L. COPENHAVER BY DEED DATED 9/4/1998 AND RECORDED 9/9/1998 IN THE OFFICE OF THE RECORDER OF DEEDS IN DEED BOOK 202 AT PAGE 0021, GRANTED AND CONVEYED UNTO KIM R. ROCK. CONDITIONS OF SALE: TEN (10) PERCENT OF THE HIGHEST SUM BID FOR SAID PROPERTY SHALL BE DEPOSITED WITH THE SHERIFF IN CASH, CERTIFIED CHECK OR CASHIERS CHECK BY THE BIDDER WHEN HIS BID IS REGISTERED, PROVIDED THAT IN NO CASE SHALLL LESS THAN ONE HUNDRED ($100.00) DOLLARS BE DEPOSITED AND THAT IN EACH CASE THE DEPOSIT SHALL BE SUFFICIENT TO COVER THE SHERIFFS FEES AND COSTS OF ADVERTISING. UPON FAILURE OR REFUSAL TO MAKE SUCH DEPOSIT, THE BIDDER SHALL LOSE ALL BENEFITS OF HIS SAID BID, AND THE PROPERTY MAY BE IMMEDITELY PUT UP AGAIN AND SOLD UNLESS A DEPOSIT OF THE SUM REQUIRED BE MADE BY A SECOND BIDDER WILLING TO TAKE THE PROPERTY AT THE HIGHEST SUM BID. BALANCE OF BID SHALL BE DEPOSITED WITH THE SHERIFF IN CASH CERTIFIED CHECK OR CASHIERS CHECK WITHIN THIRTEEN (13) DAYS OF THE SALE. FAILURE TO SUBMIT THE BALANCE DUE WITHIN THE THIRTEEN (13) DAYS WILL RESULT IN FORFITURE OF DEPOSIT, AND THE SALE MAY BE SET ASIDE. THE WRIT MAY BE ABANDONDED BY THE SHERIFF IF THE PLAINTIFF IS THE DEFAULTING PARTY. WINNING BID SHALL INCLUDE TWO PERCENT (2%) POUNDAGE ADDED THERE TO. IF NO BIDDING AND PLAINTIFF WON BID FOR COST AND TAXES, TWO PERCENT (2%) POUNDAGE SHALL BE CALCULATED AT TWO PERCENT (2%) OF THE SHERIFFS COST AND ADDED TO THE PLAINTIFFS COSTS. REALTY TRANSFER TAX SHALL BE FULLY PAID AND HAVE PRIORITY OUT OF THE PROCEEDS OF THE SALE BEFORE ANY OTHER OBLIGATION, CLAIM, LIEN JUDGMENT, ESTATES OR COSTS OF THE SALE OF THE WRIT UPON WHICH THE SALE IS MADE. THE SHERIFF SHALL PAY THE TAX OUT OF THE FIRST MONIES PAID TO HIM IN CONNECTION THEREWITH. IF THE PROCEEDS OF THE SALE ARE INSUFFICIENT TO PAY THE ENTIRE TAX HEREIN IMPOSED, THE PURCHASER SHALL BE LIABLE THE REMAINING TAX NOTICE: NOTICE IS HEREBY GIVEN THAT ANY CLAIM TO THE ABOVE DESCRIBED PROPERTY SHALL BE FILED WITH THE SHERIFF BEFORE THE SALE AND ALL CLAIMS TO THE PROCEEDS SHALL BE FILED BEFORE DISTRIBUTION. A SCHEDULE OF PROPOSED DISTRIBUTION WILL BE FILED BY THE SHERIFF ON WEDNESDAY, THE 13TH DAY OF AUGUST, 2025, AND DISTRIBUTION OF SAID PROCEEDS WILL BE MADE IN ACCORDANCE WITH THE SCHEDULE OF DISTRIBUTION UNLESS EXCEPTIONS ARE FILED THERETO, WITHIN TEN (10) DAYS THEREAFTER.
