PUBLIC HEARING Town of Bloomsburg NOTICE is hereby given that a public hearing will be held before the Town Council of the Town of Bloomsburg at 5:00 p.m. on Thursday May 20, 2021 at 911 Market Street, Bloomsburg, PA 17815. The purpose of the public hearing is for the Town Council to consider a landowner curative amendment filed by the Petitioner, Bloomsburg Senior Living, LLC ("BSL"). BSL alleges that the Town of Bloomsburg Zoning Ordinance (the "Zoning Ordinance") is substantively invalid. In challenging the substantive validity of the Zoning Ordinance, BSL has petitioned the Board for a public hearing and requested adoption of a curative amendment pursuant to Sections 609.1 and 916.1 of the Pennsylvania Municipalities Planning Code on the grounds that the Zoning Ordinance impermissibly excludes the use of a "Transitional Living Facility," thereby rendering the Zoning Ordinance invalid. In order to cure the alleged substantive invalidity of the Zoning Ordinance, PSL seeks the adoption of a curative amendment to the Zoning Ordinance. BTC's proposed curative amendment is entitled "PROPOSED CURATIVE AMENDMENT TO TOWN ZONING ORDINANCE" and is set forth hereafter verbatim as follows: "Be it ordained by the Town Council of the Town of Bloomsburg, Columbia County, Pennsylvania as follows: 1) Section 27-302 of the Town of Bloomsburg Zoning Ordinance, Definition of Terms, is hereby amended to add the following definition: Transitional Living Facility - A place that includes housing or lodging and meals and which provides a safe structured, supervised and supportive drug and alcohol-free environment, that may include peer support, employment counseling, job placement, financial management assistance, and other programs and services to individuals making the transition from controlled group quarters living to one of independent or semi-independent living in ordinary society; including but not limited to incarcerated individuals, individuals being released from drug and alcohol addiction treatment programs and/or individuals having undergone psychiatric treatment and being declared mentally competent and ready to resume life in ordinary society. 2) Section 27-514.2 of the Town of Bloomsburg Zoning Ordinance BC Business Campus District is hereby amended to add item R as follows: Transitional Living Facilities." BSL is seeking the curative amendment to allow for development of a "Transitional Living Facility" on approximately .8321 acres of land owned by BSL and located in the Town of Bloomsburg on West 5th Street, which consists of all of Columbia County Tax Parcel Numbers 05W03 12900 and 05W03 13100. The land is currently located in the Town's B-C Business Commercial and Industrial Park (I-P) zoning districts. BSL's petition and proposed curative amendment, including the request for relief, as well as plans and explanatory material are available for public inspection at the Town of Bloomsburg Municipal Building, 301 E. Second Street, Bloomsburg, PA 17815 from 8:00 a.m. to 4:30 p.m., Monday through Friday. Lisa Dooley, Town Manager of the Town of Bloomsburg.
